That's what they called a pond on my property. Apparently if one has an 'attractive' piece of land, insurance companies will not insure you if you don't build a FENCE!!!! Complete with NO TRESPASSING signs and warnings. So....I guess letting illegal entry to one's own property has negative consequences.....Who knew? BTW that's 'AN ATTRACTIVE NUISANCE'.....sorry for the bad spelling

Un-fenced, un-signed private property is regarded to have implicit consent to enter. That is, a person may enter for legal purposes of business or solicitation until told otherwise.

It only becomes trespass if they are told by the property owner or his agents to leave.

This concept is considered stare decisis, and comes to us from English Common Law.

A "No Trespass' sign pretty much tells any transgressor to leave legally however, with the Southern border we are not dealing with 'legal' transgressors.

Borders operate under a very different set of laws from private property. An international border has no implied consent of entry. One may not legally pass an international border without the permission of the state.
