Let's get this straight about Obamacare and the mandate. It was not constitutional as a penalty. We all heard it first on all the networks. It only became constitutional when the law was changed to a "tax."

And that is not how the law was written. It was how the law was argued before the justices. The attorneys for the president knew it would not be upheld under the Commerce Clause but could possibly be upheld under a tax. And it worked for Justice Roberts.

Even Justice Roberts claimed it might not be a fair and wise tax, but it was constitutional. The only problem is, that is not how the law was WRITTEN. And the dissenting opinions from the justices had severe problems with this. Is this lgeislating from the bench?

Citizens must make up their own minds.
