If the chemical actually did cause brain damage, then massive lawsuits would put the company that produces it out of business.Maybe if the judges were true constitutionalists and didn't try to legislate from the bench the would have allowed the dangerous chemicals and then "let the market decide" which is what a libertarian would do.
