States are free to implement their own plans. Obama has said repeatedly that under the law, if states can come up with a plan that would insure as many people and keep costs down as much as the ACA, then they are free to do so, and HHS will assist them in the implementation of those laws. Vermont is in the process of passing single-payer as we speak.

Included within the recently passed health care law is a provision that allows states to propose their own pilot health care programs and seek a waiver from the federal health care law so that they can pursue their own approaches to health care reform. The current law allows states to pursue these waivers in 2017.

Vermont Continues Working Towards A Universal Health Care System | FDL Action

The government of Vermont continues to chug along with their multi-year plan to establish a universal health care system modeled on single payer.

The eventual plan in Vermont is to create a universal public health insurance system, but the Affordable Care Act doesn’t allow states to apply for a total wavier to create a better system until 2017. This means Vermont is required to create an exchange for 2014, which the state will try to use as a stepping stone for implementing their full plan in 2017, if they receive the necessary waivers.
