Tennessee is on board with the feds restoring public lands based on the UNCONSTITUTIONALITY of the feds owning those lands in the first place.

If the Feds were to cede the land to the States and the States cede it to the open market.....the ranchers would be worse off. As the rate they are getting for the use of BLM land is about 1/10 that of the market rate.

Assuming the land wasn't just developed or fenced off as private property, the market rate would increase the cost to ranchers 10 fold.

Remember, ranchers don't want to *buy* the land. They just want to use it in exchange for nothing.
 
The hole in the legislation is that the feds do own the land for all of us. It owned the territories, and as each came into the union, the feds and the states contracted how the land was to be allotted. Absolutely constitutional.

Might note that the Feds also manage land through the Forestry service, EPA, and TVA.
Should people who live in NYC apartments have the same control of far away lands as other people who own and/or live on that land? Many don't think so.
 
The group pushing to sell off (privatize) the national park system to the fossil fuel industry, and sell off all public land to the highest corporate bidder, is the Koch and ExxonMobil-funded Property and Environment Research Center (PERC).

True that the tax payers already pay 93% of the welfare ranchers' fees but that's not enough. The rabid right wants tax payers to pay 100%.

Can anyone think of any other business where the taxpayer subsidizes part of the cost of doing business? Oh yeah, there's Walmart and other huge corporations that pay shit and teach their employees how to get welfare.

No appropriation of public lands may be made for any purpose except by authority of Congress.

However, Congress was held to have acquiesced in the long-continued practice of withdrawing land from the public domain by Executive Orders. In 1976 Congress enacted legislation that established procedures for withdrawals and that explicitly disclaimed continued acquiescence in any implicit executive withdrawal authority.
