Can the racist prove this was a hate crime? Because according to the logic displayed here, the sheer number and ethnicity of the teens means it was a hate crime.....

Six white teens beat up a black teen... chances they'd call that a hate crime are 100 percent.

"Congress has defined a hate crime as a "criminal offense against a person or property motivated in whole or in part by an offender's bias against a race, religion, disability, ethnic origin or sexual orientation."

6 white kids beating up 1 black kid is not defined as a hate crime unless there can be a definitive element that the motivation of the assault was in part due to the victim's race. Similarly, in this situation, it appears that the assault by these teens was due to the fact that the victim had a mental disorder.

Are you saying this wasn't a hate crime

No, unless there is conclusive evidence by the law enforcement that there was a racial motive. Just because these teens who happen to be black and outnumber one person is not conclusively a hate crime unless their motive was racial.

The victim, a 48-year-old mentally challenged woman, testified during the hearing. She told the court that four of the attackers claimed her she owed them money, something she knew nothing about. She said she was bloodied during the attack and was hit with a chair.

However, when asked if she could identify Takia Edwards, who was sitting at the defense table, she admitted she could not.

"The alleged victim could not identify my client. I think that's rather significant," said Edwards' attorney Kevin Coyne.
