As I am being facetious, yes. They need to be very harsh on them considering the current climate.

If his family didn't know that he took the gun with him, why should any punishment fall on their plates? With him being as old as he is, I believe that it all can and will fall on him. Right me if I am wrong, but once a child hits ten years of age, they are then held responsible for their own actions in the eyes of the law should they do anything law breaking. If the boy was still under ten years old, his parents would then be the ones to suffer whatever punishment was put out there.
