"Permitting the government to decree this speech to be a criminal offense, whether shouted from the rooftops or made in a barely audible whisper, would endorse government authority to compile a list of subjects about which false statements are punishable," the majority opinion written by Justice Anthony Kennedy said.

Several times, the court notes that scorn for liars in public forums, such as the Internet and a public database, might better serve to prevent false claims.

I think lefties have a skewed idea of what "Stolen Valor" in intended to do. Kerry's Military service is a subject for discussion and investigation because it was part of his campaign but it is not a "Stolen Valor" issue. Stolen Valor is intended to protect the honor and reputation of members of the Military by prosecuting people who never served but claim to be members of the Military or claim to have been awarded Medals that are not recorded. Nobody wants the federal government to investigate drunken war stories told in bars but when citizens who have never served in the Military wear the uniform or unauthorized awards either to gain notoriety or political office it becomes a violation of law and it insults the memory of real Heroes. It's interesting that this has boiled down to a left vs right issue.

Perhaps, our real problem is that we have so little moxie. Look at what we buy as the truth, in merchandise, politics, advertising, war stories, and so many times we pass a law to correct the problem, and the perpatrators simply create a new story and method and it all begins again. I think the Court giving corporations the power to spend almost unlimited money in politics needs correcting far worse than passing laws that try to correct someone wearing an unearned medal. Perhaps a course on critical thinking, the type that Texas is supposed to have shot down, would even be more appliable? We could call it Moxie 101.
