Both very good responses, but do we as American citizens or for that matter within the bounds of the states we live in have standing to call into question the qualifications of a candidate for office? Generally from what I have seen the rule most often applied is the harm rule. from what I have seen. So it wold appear that Mr. Berg and the other plaintiff in the McCain case could not establish a good enough case where they would be caused harm. IMO from reading the decision though from the judge in the case, he was not telling Mr. Berg no outright, but simply deferring it to another venue where it belongs. Perhaps because as it is not mentioned in the constitution directly it is a state matter and if I am correct Mr. Berg brought this case in a Federal Court.
