The problem with that reasoning is that Ginsberg and Kagan performed same sex marriages in States that had already voted in same sex marriage. In both Maryland and DC, same sex marriage is just called 'marriage'.

And a state's ability to vote in same sex marriage is uncontested, having already been affirmed in the Windsor decision. No case being heard by the USSC questions a state's ability to vote in same sex marriage. Nor are maryland or DC a party to any case involving same sex marriage being heard by the USSC.

So....what legal relevance does either Kagan or Ginsberg's officiating of a wedding have to do with same sex marriage bans?

I have to agree here, as both had been voted in by the appropriate legislature, not mandated by judicial fiat.

The question isn't about opposite sex marriage, so that is irrelevant. If you go with this line of logic, I have to assume the other two did as well, and thus the entire court would have to recuse itself.

Not if one is not in question, and the other is. Considering the weddings were done in jurisdictions that handled it legislatively, the point is moot anyway. The case isn't about gay marriage, but about the ability of the federal government to say gay marriage is required by state marriage contracts.

The legality of same sex marriage bans are before the court. The issue of the legality of same sex marriage was firmly established in 2013 in the Windsor decision. And since neither Maryland nor DC had such a ban, its simply impossible to demonstrate a bias against such bans by performing a wedding in either.

The legality of same sex marriage bans are before the court. The issue of the legality of same sex marriage was firmly established in 2013 in the Windsor decision. And since neither Maryland nor DC had such a ban, its simply impossible to demonstrate a bias against such bans by performing a wedding in either.

Actually the legality of the federal government saying that States cannot set their own marriage contracts with regards to Same sex marriage is what is in question.
