A New Jersey family court judge's decision not to grant a restraining order to a woman who was sexually abused by her Moroccan husband and forced repeatedly to have sex with him is sounding the alarm for advocates of laws designed to ban Shariah in America.

Judge Joseph Charles, in denying the restraining order to the woman after her divorce, ruled that her ex-husband felt he had behaved according to his Muslim beliefs -- and that he did not have "criminal desire to or intent to sexually assault" his wife.

In considering the woman's plea for a restraining order after the couple divorced, Charles ruled in June 2009 that a preponderance of the evidence showed the defendant had harassed and assaulted her, but "The court believes that [defendant] was operating under his belief that it is, as the husband, his desire to have sex when and whether he wanted to, was something that was consistent with his practices and it was something that was not prohibited."

The woman's lawyer, Jennifer Donnelly of New Jersey Legal Services, told FoxNews.com that Charles' ruling should add to the case for a proposed Oklahoma law, which will be on the ballot in November, which would ban judges from considering "international law or Shariah Law" in their rulings.

but if a Muslim chooses to COMMIT ACTUAL CRIMES, we're to stand idly by and accept that it's their RELIGION to do so?!?

I find it quite troubling, that as an avid reader of NJ news, this was the first I heard of this case. From the responses here, it seems no one else did either. Hmmmmm.

The "good people of NJ" need to know what the fuck is going on in order to vote this judge out. Thank goodness for the "rightwing nuts" bringing this to our attention. Anyone know what's going on in OK?

Unlike the U.S., with its uniform laws for all faiths, he said, Muslim nations allow Christians and Jews to follow their own laws in family matters.

He said U.S. Muslims do not want the U.S. to adopt Sharia criminal law, with its harsh punishments such as amputation of a hand for stealing or stoning for adultery.

a Texas district court ruled that the private "Texas Islamic Court" should decide the amount a husband owed his wife in a divorce proceeding -- because when they got married, they had signed a contract specifying that was what they wanted.

But assault is illegal, regardless of any contract, Volokh said, and the Appellate Court in New Jersey ruled correctly.

"The claimed religious practice of non-consensual sex involved in this case is so heinous that almost everybody thinks that you shouldn't have the right to do that, no matter what your religious beliefs are."

The husband in the case has been indicted on criminal charges and is expected to face trial in the fall.

I am very glad to see this overturned...that judge is like the one...I forget where who made some comments about a little girl coming on to her rapist and "asking for it". Some of these older male judges really seem to have it in for women....it would appear.

Never gonna happen. ( :eusa_pray: Thank (insert your preferred Deity here)!!)

Fortunately, We, The People have a good enough start in national organization that we will NEVER be ruled by ANY religious doctrine per se. Some of it makes sense and is a good law on its own - Thou shall not kill is a fine example - but (insert your preferred Deity here) DAMN the politician who suggests we live according to religious teachings of any named faith, including mine.
