S.E. Cupp Tweeted a bit from Scalia's dissent on the Arizona immigration law ruling.

RT @secupp: Scalia's dissent: "If securing its territory...is not w/in the power of AZ, we shld cease referring 2 it as a sovereign State.”

Business Insider has more, including Scalia's mention of a recent press conference by Obama. I'm thinking they don't see eye-to-eye. h/t Free Republic.

"'The President said at a news conference that the new program is “the right thing to do” in light of Congress’s failure to pass the Administration’s proposed revision of the Immigration Act. Perhaps it is, though Arizona may not think so. But to say, as the Court does, that Arizona contradicts federal law by enforcing applications of the Immigration Act that the President declines to enforce boggles the mind.'"

And why is a SCOTUS Justice commenting on politics? It just reenforces the view that Scalia made his decision based on politics instead of the Constitution.

Judges commenting on public policy is no more judicial activism than presidents commenting on court decisions is abuse of power.
 
If the decision had gone the other way Barry and his boys would be telling you how great the SC and their decisions are.

The FF wanted the States to have the power, not the Fed Govt.

Glad to see the SC is adhering to the constitution.

Way to go Scalia and the rest of the SC. Sotomeyer and Ginsberg included. LOL

Are states soveriegn if they can't protect themselves?

If they are not allowed to protect their borders, then no one can say they are. This ruling puts a dagger directly in the heart of states rights.

Judicial activism is claiming enforcing our laws is a form of racial-profiling.

Judicial activism is sighting European or International laws when providing legal arguments.

Going around Congress or ignoring current law is activism.

Actually, Scalia hit the nail on the head.

As do most conservatives on this issue.

It is unfortunate that you can't get the medical help you need to pull your head out of your ass as the fresh air, while painful at first, would give you a better view of the world.

AZ is my home state.

What is happening now is that radicals are talking about enforcing he law in their own way which will mean some dead bodies in the desert.

It is most unfortunate that Obama is to much of a fake and a moron to see that he is dooming people all in the name of his Ivory Tower world (that will never exist).

BTW: Missed you over on the Scott Walker thread. I guess you heard he didn't get recalled....but kicked your ass.
 
Scalia correctly pointed out that the federal government was going to decide which laws will be followed and which laws should be ignored including which segment of the people have to obey laws and which ones don't. We knew that already. As soon as holder said that there would be no voter intimidation prosecutions of black people we knew that the regime was going to be selective in both lawful conduct and who those laws were going to be applied to.

He didn't comment on public policy, he commented on the President.

They legislated from the bench in Bush v. Gore, Citizens United, and now this.

And if they are so in favor of states rights, why did they overturn the Montana Supreme Court's ruling yesterday?
