Santorum is correct that the Department of Justice has the legal authority under obscenity laws to prosecute much of the pornography that is currently distributed. As far as I know Obama's DOJ takes largely the same position that Bush's did, that the DOJ does not have the resources to prosecute normal pornography (as opposed to child pornography). Pornography prosecution has also been made more difficult by relaxing community standards which make juries less likely to convict pornographers.
