To take issue with the thread title, Arizona is not attempting to enforce federal immigration laws. If they were there would've been no need to pass a new law of their own. They're trying to seize control of immigration policy as it affect Arizona and supplant the enforcement policy priorities laid out in federal law with their own wishes. That's why there's a federal lawsuit. That's exactly the argument the feds are making in court, and to be quite frank, I see no way you can deny the truth of what the feds are saying in their suit.
Did you know the state of Rhode Island has nearly the exact same law in place, has been enforcing it for YEARS, and the fed has not said a word about it? Explain.
The Dept. of Homeland Security has formally certified that Rhode Island is in compliance with federal law. The procedure is called a Memorandum of Agreement. Rhode Island actively sought to obtain an MOA. Arizona has resisted doing so to this point. Lord know why, but they have.
It's an easy answer. DHS would deny one from Arizona. They denied Georgia and Oklahoma, both who had large illegal immigrant populations. That led to GA and OK passing two of the harshest illegal immigration crackdown bills in the country a few years back.
Rhode Island has very few illegals, which is why the feds approved it. Because RI enforcing it wouldn't overwhelm ICE and wouldn't cause political heat. It's a very simple answer of logistics and politics. DHS, aka the feds, wouldn't approve it.
