Anthony Ruccatano, the owner of the salon, said a health department official explained that inspectors found evidence customers had tanned more than once a week after getting a base tan — a rule he said he had never heard of in his eight years in business.

"We would all be out of business," Ruccatano said.

He said on average, people tan three times a week to treat skin conditions or depression, and to enhance their appearance.

According to the inspection report based on patrons’ files, about $3,900 of the $5,200 fine concerned "consumer overexposure," and the remaining $1,300 was for failing to document employee training, routine testing of timers, having hard-to-read warning signs, and not using fresh towels to disinfect equipment between sessions.

Customers can only use their services "once a week"? Is this fair?
