Unfortunately, I don't think the law is determined by what one guy once said on the floor of the House. How about we go look at the actual, codified laws on the subject, hmm?

US Constitution, Amendment 14 (doesn't matter what you think of it; it's still part of the Constitution):

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Furthermore, it is given to Congress to create laws regarding naturalization and citizenship, as per Article 1, Section 8, Clause 4, and Congress has provided Title 8, Section 1401, to cover this question:

Anyone born inside the United States *
Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person's status as a citizen of the tribe
Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.
Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national
Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year
Any one found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21
Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)
A final, historical condition: a person born before 5/24/1934 of an alien father and a U.S. citizen mother who has lived in the U.S.

*The exception, of course, is the phrase "subject to the jurisdiction of the United States", which thus exempts the children of foreign diplomats.


Since Mr. Rubio was, apparently, born in the United States, he is - pursuant to our Constitution and duly-passed-by-Congress laws - a US citizen, whatever his parents' citizenship status is, or was at the time.

We don't need the Supreme Court to "decide" anything on this subject, peabrain. We have laws, made for us by the people who are ACTUALLY supposed to make our laws for us (and no, that would NOT be the Supreme Court). Read them. On this subject, they're not complicated at all.

There must just be a section of the human brain marked "independence is scary; let's have dictators instead!" It's the only frigging explanation for how eager some flatliners out there are to give away self-governance with both hands.

i think one of his parents was a cuban national before castro.

So? Rubio was born in the U.S. That makes him a natural born citizen.

First, there’s no such thing as ‘anchor babies,’ as anyone born in the US is a natural born citizen, regardless his parent’s status.

Rubio is unqualified to be president because he’s a reactionary conservative hack who adheres blindly to rightist dogma, having nothing to do with his birth status.

You can't have it both ways. The left disputed Rubio's story that his parents left Cuba during Castro's regime in 1958 claiming that his parents left Cuba during Batista's regime in 1954. Either way it indicates that Rubio was born in the USA. What's the point anyway? Rubio isn't running for president. Is it a distraction invented by Media Matters to distract Americans from to the mounting evidence that the president wasn't born in the USA?

It’s the exact same idiocy the right pumps out with regard to the president.

Actually, Rubio is another Palin. A guy who appeals to the heart-strings of the base and is kind of shallow.

He lied about why his parents left Cuba and he has a bankruptcy and a foreclosure in his past.

Also, he probably doesn't like Romney all that much. Or Vice-versa.

I was being sarcastic, some run on & on about "anchor babies", and benefits of citizenship, then doubt someone born in this nation is eligible to be President. NOTE QUOTATION MARKS.

People continually confuse natural born with native born. Unless we get some serious education going in this country, it will only get worse.
