Nothing is stopping gays from creating their own legally binding common law marriages, under the Article 1, Section 10 protected right to do so.

State licensing of marriage is how politicians and bureaucrats con dupes like you into believing that you need to seek their permission to do things, which are completely within your rights to do without them.
