ANd nothing in the article indicates desperation. I think Ezra Klein is desperate to show Romney is desperate because the Obama campaign is actually desperate.

Not unusual 1 1/2 months before an election. It would unusual not to see scrambling for BOTH major candidates. Except for 2000, the hard work has made for actual elections, not the installment of a predetermined winner. It is unlikely any candidate will pull the "LET'S SUE IN FEDERAL COURT AND RUN OUT THE CLOCK!" slimy action any time in the near future.
