Those who believe Obama is intentionally violating the Constitution are fools.
ACA was passed and opined by constitutional, electoral process, and in no way deprives Americans of economic opportunity.
And tell me, when did the American People debate granting power to Congress to enter the various United States and regulate the peoples fundamental right to make their own medical and healthcare decisions and choices? And after having this debate approved the granting of this regulatory power as provided for under Article V of our Constitution which requires three fourths of the states approval, which is the only way for Congress to exercise new powers. Without this part of our Constitution being adhered to in passing the Patient Protection and Affordable Care Act how can it be claimed to be a law passed in pursuance of our Constitution?
Why are you so willing to allow the federal government to impinge upon a womans fundamental right to make her own medical and health care decisions? Is this fundamental right only applied when an abortion is involved?
Why do you ignore what the Supreme Court has stated with regard to fundamental rights? The court has stated, a law that "impinges upon a fundamental right explicitly or implicitly secured by the Constitution is presumptively unconstitutional." Mobile v. Bolden, 446 US 55, 76; Harris v. McRae, 448 US 297,312.
How can you justify the constitutionality of the shared responsibility payment when the court has stated "The mere chilling of a Constitutional right by a penalty on its exercise is patently unconstitutional."__ Shapiro v. Thompson, 394 U.S. 618.
Why are you so upset with allowing a woman to purchase health insurance to meet her own personal medical and health care needs?
