Aren't you more concerned with what Roberts said more than anything else?

Reb i would think that any case that goes before the Court that was because of our Political choices should be kicked out.....they should not be able to rule on it.....is that not what he is saying?.....

My vote counts as does yours. The legislative branch writes the laws, the executive branch enforces them and the judicial branch is NOT INVOLVED IN THE POLITICAL CHOICES. The key word is POLITICAL.

The commerce clause in the Constitution provides for the power of the federal government to levy taxes. The SCOTUS heard the testimony, read the briefs and ruled constitutionally and not politically.

Now, if you want the courts to be a political arm of the federal government, you must learn to stop grousing about 'judicial activism' when strictly political rulings are set forth.

He is right. Tax increases are a well established right of Congress, so he cant just toss out Obamacare because he doesnt like it. He can only strike it down if its unconstitutional and since Congress can raise your taxes then give you a deduction for buying that widget, they can use taxes to coerce you into buying things you dont want, but they could have done that BEFORE the Obamacare decision anyway.

Conservative activists are missing the boat on this one due to their emotional disapointment.

Yesterday was a huge victory for conservatives: (repeat text to save time)

1. It makes the Obamacare law easy to repeal. Since it is a tax legally now, there can be no filibuster to defeat a repeal in the Senate, so the GOP only needs 51 votes now not 60.

2. It struck down individual mandates. An individual mandate can have many kinds of penalties from house arrest to property forfeiture to jail time, but since Roberts accepted the Obama argument that this was a tax, the only 'penalty that can be assessed in this case is a fine and it can pass in the form of a tax increas for everyone that buying the insurance allows you to be exempt from. This is a huge decision in favor of individual rights.

3. This decision has made the law a plain out right tax increase, making Obama the unsurpassed record holder for tax hikes in US history, as well as for deficit creation.

4. Lastly, but most importantly, he struck down the Medicaid withdrawal for states that opt out, saying that such laws are unconstitutional and violate the Tenth Amendment. This is the by far the biggest set back to the growth of federal power since the Civil War. Now if Congress passes another law like the mandatory seat belt law which penalized a state by witholding its highway funds if they didnt make seat belts mandatory, the states can take it to court arguing that in the Obamacare decision these kind of penalties are unconstitutional. This just cut the domestic testicles from DC as a power center, and we are going to see states act much more autonomously from now on.

Obama and crew advertised the individual mandate in the PPACA as constitutional under the commerce clause. When the Solicitor argued the case in court, it all of a sudden became a tax.

Back to the comment. Chief Justice Roberts has reminded the electorate that elections have consequences and if the People do not approve of the policy of the current administration, changes can be made in four months.

Your vote counted! It just so happens that your vote was in the MINORITY and the MINORITY does not win in voting. See, the way it works is, if you have MORE votes, you win. If you have FEWER votes, you lose.

And the courts rule on the constitutionality of laws, not the POLITICAL CONSEQUENCES of the laws.

Jim, since it is a tax, we can also make it an income tax on all forms of income to support a single payer universal health care system. And that is eventually what will happen.

Why do you think that Ted Kennedy couldnt get that past for 50 years? No matter what the Dems had in Congress or the WH, they NEVER could pass that and they never will, IMO.

Socialized medicine is on its way to the trash heap of history as its flaws have been well documented for some time now.

What is going to come about is a well regulated market where individuals can buy health care insurance that meets government specs and people wont have to get it through their employer due to costs anymore. That will happen.

Obamacare was a step in that direction with the state health care exchanges but the law had a lot of bad pills in it, the majority of which got purged yesterday, IMO.

The state operates best when it regulates human activity and not when it directs it via one size fits all policies. Let people choose what they want, that is the future.
