Rick Santorum and the Republican dichotomy of "government"

Rick Santorum: States Should Have Power To Ban Birth Control, Sodomy

This dumbass is too preoccupied with controlling what goes on in people's personal lives, will he stay the fuck out of people's bedrooms?

The Republican dichtomy about "government" is fucking dubious, to me government is government be it state or federal government, I want neither dictating to me what i can do in the bedroom and if women want to take birth control so as not to have unwanted pregnancies thats their choice regardless of whether I garee with it or not.

Why fucking make federal government look bad and state government look good when it comes to violating personal liberties? Dumbass Repugs.
Stupid libtards though love socialists in the white house. Idiot.

You mean giving states the rights that are their's by the Constituition?
Scandalous.

As to whether there is a right of privacy in the Constitution, some thoughts on the subject may be found here:

The Right of Privacy: Is it Protected by the Constitution?

"The U. S. Constitution contains no express right to privacy. The Bill of Rights, however, reflects the concern of James Madison and other framers for protecting specific aspects of privacy, such as the privacy of beliefs (1st Amendment), privacy of the home against demands that it be used to house soldiers (3rd Amendment), privacy of the person and possessions as against unreasonable searches (4th Amendment), and the 5th Amendment's privilege against self-incrimination, which provides protection for the privacy of personal information. In addition, the Ninth Amendment states that the "enumeration of certain rights" in the Bill of Rights "shall not be construed to deny or disparage other rights retained by the people." The meaning of the Ninth Amendment is elusive, but some persons (including Justice Goldberg in his Griswold concurrence) have interpreted the Ninth Amendment as justification for broadly reading the Bill of Rights to protect privacy in ways not specifically provided in the first eight amendments.

"The question of whether the Constitution protects privacy in ways not expressly provided in the Bill of Rights is controversial. Many originalists, including most famously Judge Robert Bork in his ill-fated Supreme Court confirmation hearings, have argued that no such general right of privacy exists. The Supreme Court, however, beginning as early as 1923 and continuing through its recent decisions, has broadly read the "liberty" guarantee of the Fourteenth Amendment to guarantee a fairly broad right of privacy that has come to encompass decisions about child rearing, procreation, marriage, and termination of medical treatment. Polls show most Americans support this broader reading of the Constitution."

So the argument that the Constitution contains and protects a right to privacy is not without foundation. You may disagree with it, but that you are right in doing so is not self-evident.

As to whether, as asserted earlier, Santorum believes that states should ban birth control -- a distinct question from whether he thinks they should be able to -- I give you this:

Rick Santorum said:
One of the things I will talk about, that no president has talked about before, is I think the dangers of contraception in this country . . . It’s not okay. It’s a license to do things in a sexual realm that is counter to how things are supposed to be.

Do you believe its constitutional for the government, state, local and or federal, to tell you how to have sex and to tell you you can't use condoms and other forms of birth control?

Yes. WHy wouldn't it be? WHat article in the COnstitution would prohibit state governments from doing that?

I don't believe the Government has the right to tell me I can't wear a condom, gtfo.
Which article protects your right of privates?

There is nothing in the Constitution that tells me where and how to stick my dick in something, the Constitution doesn't regulate my dick. If you're ok with it that's you both most Americans are not.

Right/ There is no mention at all. That leaves states free to do so, per the 10th Amendment.

If you want the government, state or fed to legislate what you do in the bedroom thats your proble, but states that were given power fucked up in the past, they banned interracial marriages for example and enacted segregation. Government is fucking government state and or federal, it doesn't matter.

4th Amendment: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Santorum is not suggesting the Government legislate anything.
He is recognizing states rights as granted by the Consitituition.

And you would be ok with having your dick regulated as long as its done by the states and not by the feds? You're a fucking retard.

Yes, he is.

By the way feces4greymatter these are the same rights that states have taken advantage of to legalize homosexual marriage.

State laws are legal as long as they fall within the limits of whats allowed in the Constitution, if you want Christian Talibanstards regulating your sex life as long as its done by state laws you're fucking retarded.

No, exactly the opposite. A state can grant MORE rights to the people than the federal government does; that's not at issue.

So essentially as long as states pass laws that fit your hack agenda you are fine with them.:cuckoo: :banana2:

No, thats retarded ass Santorum's position.

States have to follow their own constitutions too so you can't really say what states have the right to do unless you actually read each states constitution. Keeping the federal government out of the bedroom is a good start. Keeping the state out is also a good idea though.

Do you know how to read? Do you knows "search and seizure" means? What is being searched and seized? Nothing.
You are an ignoramus.

I didnt say that, fucking retard.
the point is not whether they should do that. The point is that they can do that.
The distinction is probably lost on a peabrain like you. But people with more than 2 functioning brain cells get it.
