The Constitution says that individual rights cannot be infringed on by a state. Sometimes states pass questionable laws that must be ruled on.

Man did you miss the point. The feds striking down state laws that may infringe on individual rights is one thing...and it rarely happens. The feds passing laws that expand THEIR authority beyond the enumerated powers is clearly unconstitutional...unless you're a progressive in which case you clearly know what's best for everyone else...
