(CNSNews.com) – In the waning days of the Bush administration, the Department of Justice (DOJ) is mulling whether to recommend a commutation for the two former Border Patrol agents jailed for more than a decade each for shooting a Mexican drug smuggler in the buttocks.

The case is now before the DOJ’s Pardon Attorney Donald Rodgers. The Office of Pardon Attorney works in consultation with the attorney general’s office to assist the president, who has sole power of clemency in federal cases under the Constitution.

Ultimately, it is the president’s call regardless of what the Office of Pardon Attorney recommends.

You really annoy me. You think an illegal alien is equal to an immigrant and you think these border patrol agents deserve more time in jail that the repeat drug smuggler that they shot. What's worse, you probably actually believe that the repeat drug smuggler didn't have a gun.

They committed felonies. The truth is these agents fired 15 shots at an unarmed man who was running away from them and who posed no threat. These agents were found guilty by a unaminous jury. The jury heard all evidence and testimony. The problem for the agents is that the jury did not believe them.

The agents knew that they were supposed to report the discharge of the firearms to their supervisor---no supervisor was present at the scene. The agents did not report the discharge because they knew it was not justified. They were aware that law enforcement resources would be dispatched to investigate the shoot. The bullet extracted from the drug smuggler came from Ramos service weapon. Testimony from Agent Juarez verifed that the drug smuggler was unarmed and was almost to Mexico when Ramos and Compean began shooting at him. The evidence was compelling that the drug smuggler was unarmed.

Officers are sworn to abide by the law--even when dealing with illegal immigrants. These agents screwed up and they are paying the consequences.

Their appeals have been denied. The sentences stand. They were convicted of assault with a deadly weapon and obstruction of justice. Compean collected the shell casings in order to prevent them from being used in official proceedings.

Just because you hate illegal immigrants doesn't give Border Patrol agents the license to break the law while apprehending criminals. The agents took the law into their own hands, and they are suffering the consequences.

Border Agent Juarez testified that the drug smuggler was unarmed. There was plenty of evidence that had nothing to do with the drug smugglers testimony.

They shot fifteen times at an unarmed assailant, they failed to report the shoot and destroyed evidence.

Eye witness testimony demonstrated that the assailant had his hands up ready to surrender--he took off running AFTER one of the agents struck him with the butt of his shotgun.

It was a fair trial.

And how did Juarez know, since he got away? Hmmm? Did he follow him? Or is this the border patrol agent that was childhood friends with the drug smuggler?

The doctor concluded that the entry and exit wounds were consistant with someone who was turning and pointing something while running away.

Wonder what that something he was pointing was? His finger?

You honestly believe that a REPEAT drug smuggler didn't have a weapon on him????

If he didn't have a gun, they had no authority to shoot him.

The trial is after the fact.

So, how do YOU know? Did you follow him?

You think that last sentence stands up as proof in a court of law that those agents had authority to shoot him? The law is the law and you can't just kill someone if you are not imminently threatened, just because they are an illegal alien does not make their life worthless.
