They won the suit in federal court and that decision was upheld by the court of appeals, so yes what he did was illegal. Note to the brain dead, there is currently one country on the Deferred Enforced Departure list, that would be Liberia. There are a few others that are on the Temporarily Protected List, most have expired. Your country has to be on one of those two list to be eligible for work permits.
