Now doesn't that just shoot the argument out of the abortion decision (Roe vs Wade) and another potential decision regarding gay/same sex/ marriage as being allowed to be decided solely by the courts?

Let's face it folks the Congress and Executive have been less than courageous in fullfilling their role of making and passing law.. We cannot allow this abrogation of the will of the people to long continue... Or we have "ceased to be their (our) own rulers...

I dont know about Abortion, but gay marriage was on the ballot in California and the people voted against it. it didnt stop civil authorities from violating the law and forcing gay marriage on the people.
