The children, and the parents themselves, of illegal aliens are under the jurisdiction of the USA, which means they can be arrested and prosecuted and convicted of crimes by the US.

Diplomats are not under the jurisdiction of the USA and cannot be arrested, prosecuted, or convicted of crimes by the USA.

you think it has to do with the status granted to the individual and you're right. the government recognizes diplomats as representatives of their home government. as such they are not subject to our jurisdiction but remain under the jurisdiction of their home government.

other resident aliens, legal or otherwise, are not representatives of their government. they fall under the jurisdiction of the united states.

In many cases, there is no clear country where they would otherwise be citizens. Their sole means of documentation is what they receive here. They are natural born Americans, and their parents' actions have no bearing on the fact.

for the purposes of the 14th amendment there is no difference.

and if you understood diplomatic immunity you would understand that the diplomats are not, generally, considered to be under our jurisdiction.

Yep and also, WE, as in American Diplomats in foreign Nations... WANT the Protection of being ONLY under the Jurisdiction of USA laws and NOT the Laws of the countries they visit or temporarily live for their government assignments.
 
The other group of people that are NOT under USA jurisdiction are the Military of an invading foreign Nation if at war, as example...the Military troops of an invading foreign nation's children born on our soil are not citizens...they are here on our soil representing their country, and through the direction of their government, military, and War.
