Does anyone have any experience dealing with the mentally unbalanced?

I deposited 60 cash for an apartment on the 199th of last month, have the receipt. I gave the balance of 1st month and security via check on the 1st of this month. I called the next morning to complain that the place was still pretty dirty, and that a security deposit was to insure that I left it as I found it. I was not rude.
He called me back that morning and went a little nuts, you know, on the offensive, but we left it that I was going to have the number for the land lady (his sister in law) and the rest of the keys by Monday morning. I worked all weekend on the place, cleaning and washing windows, hanging curtains, hauling stuff up there, a washer and dryer...

Tonight he calls me, wakes me out of a sound sleep, to scream at me over the phone that I have to get my "shit out" or he'll throw it out of the window.

So I went there tonight and called the police, the officer said he would testify that I do indeed have a key, all my stuff was there, and that I need to call civil courts or some such in the morning. My boss is calling her father, a lawyer, to help me. I have to work tonight, all my stuff is there, and if he changes the locks I'm SO screwed.

I got the number for his sister who informed me that the check wasn't cashed and she doesn't think it'll work out. I told her that I worked all weekend getting stuff straight in there, that what she was trying to do is not legal, her agent's behavior was not normal, and that I'm contacting the authorities. I have video of the place, the key turning the lock, the officers testimony, and the receipt. How do I deal with this nightmare???:eusa_eh:

Bummer! Take as many pictures as you can of EVERYTHING. All of your stuff, the condition of the apartment...everything. That way he cant say you damaged anything...and if he damages any of your things you have photo prof.

Regardless of how this works out..i think you might want to find somewhere else anyway. I wouldn't want them as landlords. You would never know when they would go psycho again.
 
Damn, Barb.

You've got your bases covered with the photo/video evidence and the po-po testimony. At least you found out right away that the landlord is crazy. Although you could take them to court and get a verdict in your favor, I think it would be best if you got out of that situation completely. I know you did a lot of work to move in, but moving out and finding a new place would probably be less stressful and headache-inducing than having to deal with this assdouche as your landlord.

Get with your lawyer ASAP and follow his advice...meanwhile, you need a new place to live. Eventually you may be able to recoop all these unnecessary charges, but that's not today's issue. Open the classifieds.

Photogragh, photogragh, photogragh....and try to avoid going back there without a police escort. At a minimum, don't go alone. If you find the locks have been changed you might be able to legally break in...ask your lawyer.

You started trouble with the landlord on the first day. He was very smart to not cash your check. You are signaling that you are trouble.

Pack your bags and get out. You are a thief. You never paid for shit if your check was not cashed. Your belongings have not been there long enough to establish any sort of legal residency.

next time learn to STFU or better yet, stop being such a control freak with other people's property

You dont want to be in a situation with hostile people who can fuck up your shit while you are gone or sleeping .
Your tires will be slashed , paint job ruined and your refrigerator unplugged and your valuables ruined in freak floods.

if he changes the locks....more power to you...cause he is gonna be in a heaping helping of trouble...
keep all your receipts and photos...you are gonna end up in small claims court...

if the check has not been cashed...put a hold on it...stop payment....you can show good reason for stopping payment....but you got to pay for the the time you used the place...as for the cleaning...you should be able to recover that...

now...get you a damn inside lock..something they cant control...it can be simple....when you are there....wedge a straight back door under the doorhandle....dont let him in period...if he says he can enter under the lease...call the police and have a policemen there the whole time....

do what you have to do to protect your person and property....the rest will be court or some type of litigation....pain in the ass i know....

but above all..dont take the mal...you dont have to

o and find out your right in your state....it varies state to state

Actually, every local and state official I spoke to says I took possession of the property and established tenancy when he accepted my check and gave me keys. The electricity is on in my name, and I will be staying long enough to make sure he is forced to meet his responsibilities. He brought the check back to the apartment and left it on the stove. Those funds will be placed in escrow until the repairs are made. Its almost winter, there are windows broken and others that do not close completely or at all. Code enforcement is getting involved because the attempted eviction took place as retaliation for bringing enforceable code to his attention. He can go to jail for that. He's a slumlord, and he ran into the wrong woman with his bullshit.

If he goes to jail, does the property become yours?

No, but I can sue for triple damages. It will help with the extra expenses of having to move all over again. I can honestly say I've never had a bad landlord before, and running into all this was a pretty hard mental shock. I'm over that now though. I'm set for a fight if need be. Since I took care of all the groundwork today, its him on the defensive, and I'm pretty secure where real property law protects tenants.

Even if this gets straightened out and you stay, you're never going to be happy there and there will always be an element of distrust. My advice is to cut your losses and get the hell out of there and find a more civil place to live. I understand the "stand your ground" and take no bullshit stuff and you might win the battle but in the long run you will loose the war. I doubt if you will ever have happy memories of this place so like I said, cut your losses and get out of there - quick.
