Smoking Banned Inside Santa Monica Residences

The city council voted 4-2 on Tuesday to expand a smoking prohibition in the coastal city.


Smoking is already banned at beaches, parks, restaurants and near buildings in Santa Monica, but Tuesday night the city council sought to expand that prohibition and voted 4-2 to ban smoking for all new tenants of apartments and condos inside their residences – with one exception.

“It also requires existing residents to designate their units as smoking or non smoking and from then on it will be prohibited to smoke in a non smoking unit,” said Adam Radinksy, head of the Consumer Protection Unit in Santa Monica.

The coastal city’s smoking bans date back almost two decades and Radinsky – along with other supporters of the ban – say the measures are in the interest of public health.

“People have come to testify to city council about asthma problems, people who had no prior health problems who developed health problems because their neighbors smoke,” he said.

Wayne Jackson, a smoker, says Southland residents breathe in pollution all day – pointing to a bus passing by as a “health issue.”

“I think it's a little too much control,” he said.

Jennifer Jones – who exercises in her apartment – describes smelling her neighbor's cigarette through the walls and vents.

“It’s not like a light smoke; it's really heavy,” Jones said.

Still, she has concerns with the new ordinance.

“I really don't think they should be telling people what to do if they are paying for the place they're living in,” Jones said.

Other cities have taken similar measures. Pasadena will make all apartments, condos and townhouses smoke-free by 2013 – a move Santa Monica is also looking into...

This has been going on for a while, when I lived in California my landlord specifically listed no smoking as part of my leese agreement.

Thats different. You signed a contract renting the house. You had a choice to sign the contract.

I didn't really care at the time I would just go outside and smoke.

I don't see how people should be told to do what they can and can't do in their own home. I do understand the angle that the smell can be difficult for neighbors and believe me as a non-smoker I think it's disgusting, but unless it's actually harming someone I can't see how anyone can be told what they can do in their own home.
 
Once you rent an apartment the interior is your property subject to the laws of the municipality. Interestingly enough, the protection of rental property use was upheld and restrictions overturned back when landlords had rules that they wouldn't accept people with children. Try to rent an apartment with a drug use restriction and evict pot smokers. See where that gets you.

This is going to end up in a morass of legal entangelments and will largely be ignored.

I don't know the anti smoking campaign is strong, they are talking about taking down all the smoking areas at my job next week. Pot smokers and cocaine users have more rights than smokers right now.

What happens if your neighbor doesn't like you and accuses you of smoking in your apartment just to get you out? Can someone PROVE they don't smoke? Of course they can't because you can't prove a negative. That's why this is going to become such a legal mess. I was at a hotel where a woman who was checking out was refusing to pay for her room because she claimed that the previous occupant had smoked in the non-smoking room. She could smell it, though no one else could. Prove they didn't smoke.
 
I was at an art show and a man became irate claiming he could smell cigarette smoke from my e-cigarette. I told him to get the fire marshal and if the fire marshal could smell cigarettes I'd put my e-cig away.

The fire marshal told the man that I wasn't smoking and if he didn't like what I was doing, he could leave. The point is, he swore that he smelled cigarette smoke when there was no cigarette. You know this is going to become common.

It's pretty easy to tell whether someone has been smoking or not, especially in a rental. Burns on the carpet, even along the edge of the bath tub (yes, I've seen them), nicotine stains on the walls and windows (and, yes I've seen them too).

I think this will affect more security deposits and insurance claims than cause tension between neighbors/landlords.

You can already do stuff like that now, I can call the police and lie and say my neighbor smoked crystal meth and to come arrest him. You have to have proof of these things, I checked into a non smoking room in Baton Rouge with my girlfriend and the room had an ash tray in it and smelled like one too, not everyone follows these rules.

Cigarette taxes support the State Children's Health Insurance Program (S-CHIP). If you get rid of all those evil smokers, millions of poor children would go uninsured. Why does California hate poor children???

It's a simple Question of the Constitutionality of a Local Government restricting peoples rights on Private Property.
