Actor Paul Reubens Pleads Guilty in Obscenity Case

LOS ANGELES (Reuters) - After a 2-1/2-year investigation in which prosecutors examined 30,000 images seized from his home, actor Paul Reubens pleaded guilty on Friday to a single charge of possessing obscene material.

The children's actor, who won fame as television's "Pee-wee Herman," was sentenced to three years of probation and ordered to keep away from children during that period.

His lawyer Blair Berk claimed victory, saying prosecutors had dropped a more serious child pornography charge and had agreed to allow Reubens to appeal the case to a higher court.

The plea deal also requires Reubens to register as a sex offender, but the case will be expunged from his record and his name removed from the state database if he finishes probation.

During his probation, Reubens, 51, must avoid anyone associated with the case, attend psychological counseling for a year, and pay a $100 fine.

Reubens, who did not appear in Los Angeles Superior Court, said in a statement that he was pleased to have avoided "a circus-like trial" and was "disappointed any part of my art collection was ever deemed inappropriate."

"These are certainly troubling times when our Attorney General Ashcroft has actually ordered the semi-nude statue of the Spirit of Justice to be covered with drapes," Reubens said.

"Taking responsibility by calling a few images in this collection 'obscene' and paying a $100 fine seemed like the sanest way to make it end," he added.

"TREATED FAIRLY"

Deputy City Attorney Richard Kraft said he was "pleased" with the plea agreement and described the images underpinning the case as "photographs in magazines depicting minors engaged in sexual conduct."

"We believe that Mr. Reubens was treated fairly and properly by the City Attorney's Office," Kraft said. "The disposition in this case took into account all of the facts and circumstances of the case and legal issues."

Kraft said the "nonsexual" images seized from Reubens' home in November 2001 would be returned to him but materials "involving sex" would be destroyed.

City Attorney's Office spokesman Eric Moses said the case was based on "170 images of minors engaged in sex conduct ... minors with genitals exposed, engaged in oral copulation, masturbation and multiple people engaging in sexual conduct."

Berk disputed that account, saying the photos were taken from magazines published decades ago and had no overt sexual content.

She also accused Los Angeles police of planting a videotape among the 30,000 items seized from Reubens' home, and said Reubens planned to challenge the case in state appellate court on free speech and illegal search and seizure grounds.

"The most important aspect of this is this debate will continue outside the courtroom," she said.

The lengthy case, fought mostly behind closed doors, galvanized civil rights and gay activists, who rallied to Reubens' defense.

Reubens was charged with a single misdemeanor a day after "Amadeus" actor Jeffrey Jones was charged with allegedly taking sexually explicit photos of a 14-year-old boy who also made accusations against Herman and another man.

The boy was a relative of an art dealer who had sold all three men lots from a large erotica collection, a source close to the case said.

Jones pleaded no contest in July to child pornography possession and was sentenced to five years probation, and the other man, Philip Hiland, was convicted of the same charge, prosecutors said. Hiland's sentence was not immediately known.

I read about this case, and it was ridiculous. Paul Reubens evidently had a large collection of old and quirky art. Reubens and his lawyer, as it states below, have vehemently denied that he ever possesed images of minors engaged in sex acts. Reubens has had strong support from many of his friends including David and Courtney Cox Arquette and others.

The fact that he won't even be required to register as a sex offender once his probation is up should tell you they didn't have a case. I think he just copped a plea to be done with this whole stupid case, and so he could appeal it quicker. This case goes back to the heart of the old question, what is obscene and what is art?

how is this <I>not</I> porn? i know there is a think line between child art and child porn, but if they are depicted engaging in sex acts.... despite whatever you call it, oral copulation is sex

What you quote Johnney is a claim made by the prosecution, one they evidently didn't think they could prove in court.

My guess is they didn't have any evidence, but they didn't want to look stupid so they either planted evidence or simply made it up. If they really thought Reubens was a danger, they wouldn't have only fined him $100 and put him 3 years probation. Clearly they had no case, but Reubens didn't want to go through a trial, which frankly, I can totally understand.

I agree, if their case was that strong would the prosecution have agreed to the plea?

Registering as a sex offender ought to cause him to think more carefully about his actions, but I don't think Pee-Wee is a threat to anyone.

The Dumbass got caught, was investigated, found to be the owner of pic's of minors in sexual postitions, frontal, oral and otherwise. Too bad he didnt have to do any time. I am sure he would have had a blast in Jail. As for his supporters? They need to be investigated for standing up for him. Makes me wonder if they shared "Collections"? As for registering as a Sex offender
Who did he offend? He committed no crime against another person, only himself. If you dont consider Child porn obscene you have a serious problem and should seek help.

He was interviewed recently on this and they aired some of those pics (blurred out in part of course) - yes I would consider them disturbing - art aside - they were photos of young boys engaging in homosexual activity. Art? Perhaps if it were of age men but boys? I gathered the boys may have been around fifteen years of age.
Paul did state that he did not know how old the boys were but admitted they certainly looked quite young.

Meanwhile I didn't know he would not be considered a 'sex' offender after his probation....

I remember watching OJ Simpson on Donahue one time and thought he had come across as one of the nicest fellows anyone could meet. He was joyous and had a great sense of humor and seemed an all around together man - what did I know?

I actually have an issue with Johnny Cochran presenting the case to the jury like it's their duty to rectify the racial history of america by putting a killer on the streets.

I saw PeeWee's comedy show on a Paddle boat in New Orleans , he was easily one of the funniest comics ever . The show was not a kid's show at all , much more adult oriented. His movies were great fun for kids and adult fans and his Saturday morning show was brilliant . He filled that show with sexual inuendoes that only adults would understand but always left the kids with great positive messages , certainly better than the violent crap that kids watch today. It is amazing how many big names in hollywood showed up on that show . I remember Phil Hartman played Captain Carl and Lawrence Fishburne was Cowboy Curtis .
I don't know why the police have decided to go after him , I never have heard why there were so many cops in that adult movie theater in Florida , I think there were six or eight .
It is amazing how strong the law inforcement is when it comes to sex , I wish they would do half that much towards inforcing the drunk driving laws . I certainly don't advocate letting people that take advantage of kids get away with crimes but it would appear that Paul Reubens is getting more attention than others that do serious crime that hurts others . I don't think he is responsible for the taking of those photographs.
