Many fathers take baths with their baby daughters all the time they aren't charged with raping them unless their is some kind of psychical evidence of rape.
I'm not following here either there was psychical evidence of a rape to have to take DNA samples or there was no psychical evidence of a rape, and in that case they should have never took any DNA samples.See bolded.
