Parents of tattooed teen sue NH school district

According to the latest bogus statistics, 1 in 6 kids is bullied at school each year. This begs the question: "Should every victim of bullying have a personal body guard?" Should every kid with a history of cutting, get a personal escort? Should every kid with ADHD have a one on one aide?

If it was written in the IEP that an adult was to be with him for 7 hours a day, then bones may be right. However, I'm surprised that information wasn't made public in 2010, when this happened. It is possible that the parents believe that this what the school "should have done", not what they were legally required to.

In the NH school suit, the school should not be held accountable for what bullies did off of school grounds. The bullies themselves should all be locked up and their families forced to pay compensation to the victim of the bullies. But, some faggot Jew lawyer wants to go after the deeper pockets of the taxpayer-supported school.
 
the school entered into a contract with the parents....(if) then they have broken the contract and are liable....


now as for 1 out of 6 being bullied i would imagine that is a pretty accurate figure.....i have no clue how to stop bullying but i am a firm believe in truant officers and feel we should go back to them...

Their son was a 14-year-old high school freshman in 2010. Police say four people were accused of luring him into a home's basement where they tattooed a lewd image and words on his backside. They pleaded guilty to charges stemming from the incident and served between several days and six months in jail. Three were high school students; they were expelled.

The Concord Monitor reports (NH news, primary 2012 coverage, sports, opinion & photos | Concord Monitor) the suit says the school knew the boy was being bullied and missed classes, but didn't help him. The parents say he has learning disabilities.

An attorney for the school district couldn't be reached to comment.

Not sure how schools are supposed to be held, "responsible for bullying off school grounds?"

The scenario seems similar to school's responsibility for child abuse off school grounds: Teachers are required to report incidences of child abuse IF THEY ARE AWARE OF IT.

From reading the description of how the bullying happened, I cannot tell one way or the other if any school teacher or administrator knew the kid would be tatooed, nor can I conjure up any plausible scenario where anyone could have predicted the bullying incident.

NJ aready had a tough anti-bullying law, but the new law expands it to "off school grounds" and also has language that includes what school staff know or "should have known". I suspect it will be challenged.

The new law states that schools have a duty to address bullying that occurs off school grounds IF the behavior meets the legal definition, including:
‣ Causing a substantial disruption, AND
‣ Either
‣ Demeaning a student or group of students
‣ Creating a hostile educational environment

So, the parents are suing the school for failure to protect the kid? Why don't they sue themselves for their own failure to protect their kid? How could something that didn't happen at the school be the school's fault? And, don't the parents have any responsibility either?

Or, dont' they have deep enough pockets? The kid was skipping classes. So, why didn't the parents hire a chaperone AT THEIR OWN EXPENSE to monitor their kid who didn't listen or follow rules? Why should the school have to be responsible for that?
 
It won't be long before a parent sues a school for the kid picking up a cold virus at the local mall from another student...

I, in no way condone hiring chaperons for problem kids, but once they do, they become responsible for the failure of that chaperon to protect or monitor their charge.
 
I can't see how schools can be responsible for bullying off school grounds. Maybe the school should sue the parents for allowing their kid to be bullied. Pretty horrible torture for a young kid to be tattooed against his will. I'd say the criminals got off too easy. Maybe the courts and the Police should be sued.
