The jihadist ship announced at the outset its intent to violate Israel's lawful blockade of Gaza, which is a terrorist base in a declared war with Israel.

Thus, Israel was entirely compliant with maritime law in intercepting the vessel, even in international waters, provided Israel did not violate the coasts or ports of neutral states, which Israel did not do.

Israel first determined beyond a reasonable doubt that the ship in question was attempting to run a blockade, thus making it subject to detention under the standards shown above. It also took “all feasible precautions in the choice of methods and means in order to avoid or minimize collateral casualties or damage” by boarding the ship with non-lethal weapons, and resorted to deadly force only when subjected to deadly force.

According to the United Nations Relief and Works Agency, the organization set up to address the needs of Palestinian refugees in Lebanon and elsewhere, Palestinian refugees in Lebanon have the highest proportion of special hardship cases among those in any country in the region.
An extensive study by the Norwegian social welfare research organization Fafo found that just 15 percent of adult Palestinians have employment contracts. Forced to work illegally and without legal protection, Palestinians face severe discrimination in wages and hiring. Many employers pay them less than their Lebanese colleagues, or refuse to hire Palestinians.

"If there is a work shortage, they will hire you, [but] because you're Palestinian and it's not allowed, they will pay you half," one Palestinian told Human Rights Watch. As Palestinians, he added, "We are not asking for money, we are asking for the right to work, to live in dignity."

I am the former commander of the British forces in Afghanistan. I served with NATO and the United Nations; commanded troops in Northern Ireland, Bosnia and Macedonia; and participated in the Gulf War. I spent considerable time in Iraq since the 2003 invasion, and worked on international terrorism for the UK Government’s Joint Intelligence Committee.

Mr. President, based on my knowledge and experience, I can say this: During Operation Cast Lead, the Israeli Defence Forces did more to safeguard the rights of civilians in a combat zone than any other army in the history of warfare.

Israel did so while facing an enemy that deliberately positioned its military capability behind the human shield of the civilian population.
Hamas, like Hizballah, are expert at driving the media agenda. Both will always have people ready to give interviews condemning Israeli forces for war crimes. They are adept at staging and distorting incidents.


The IDF faces a challenge that we British do not have to face to the same extent. It is the automatic, Pavlovian presumption by many in the international media, and international human rights groups, that the IDF are in the wrong, that they are abusing human rights.

The truth is that the IDF took extraordinary measures to give Gaza civilians notice of targeted areas, dropping over 2 million leaflets, and making over 100,000 phone calls. Many missions that could have taken out Hamas military capability were aborted to prevent civilian casualties. During the conflict, the IDF allowed huge amounts of humanitarian aid into Gaza. To deliver aid virtually into your enemy's hands is, to the military tactician, normally quite unthinkable. But the IDF took on those risks.

Despite all of this, of course innocent civilians were killed. War is chaos and full of mistakes. There have been mistakes by the British, American and other forces in Afghanistan and in Iraq, many of which can be put down to human error. But mistakes are not war crimes.

More than anything, the civilian casualties were a consequence of Hamas’ way of fighting. Hamas deliberately tried to sacrifice their own civilians.

Mr. President, Israel had no choice apart from defending its people, to stop Hamas from attacking them with rockets.

And I say this again: the IDF did more to safeguard the rights of civilians in a combat zone than any other army in the history of warfare.

A perusal of Jewish history, a reading of Josephus, will convince the most skeptical that the grandest fight that was ever put up against an enemy was put up by the Jew. He never thought of leaving Palestine. But he was driven out. But did he, when driven out, give up his hope of getting back? Jewish history and Jewish literature give the answer to the question. The Jew even has a fast day devoted to the day of destruction of the Jewish homeland.

Never throughout history did they give up hope of returning there. I am told that 90 per cent of the Jews today are praying for the return of the Jewish people to its own home. The best minds among them believe in the necessity of reestablishing their Jewish land. To my mind there is something prophetic in the fact that during the ages no other nation has taken over Palestine and held it in the sense of a homeland; and there is something providential in the fact that for 1,800 years it has remained in desolation as if waiting for the return of the people.
