The Maricopa County Attorney's Office said Altamirano is in the U.S. illegally and was out on bond while U.S. Immigration and Customs Enforcement determined whether he should be deported.

MESA, AZ (CBS5) -

An undocumented immigrant from Mexico was out on bond when he allegedly shot a store clerk in Mesa on Thursday.

Apolinar Altamirano, 29, was captured early Thursday morning in the West Valley after a chase with Mesa police and Arizona Department of Public Safety officers.

He is suspected of shooting and killing Grant Ronnebeck, 21, a clerk at the QT store at 414 S. Stapley Dr.

Police said surveillance video showed Altamirano walking into the QT about 4 a.m. Thursday and asking Ronnebeck for a pack of cigarettes. Ronnebeck asked several times what type of cigarettes, and Altamirano pointed to a pack behind the counter, a Mesa police officer said.

Altamirano then dumped a jar of coins onto the counter and Ronnebeck told him he needed to pay for the cigarettes first, the officer said.

Altamirano became agitated and pulled a gun and pointed it at Ronnebeck, who then tried to hand the suspect the pack of cigarettes.

Altamirano said, "You're not going to give me my cigarettes," and fired one shot into Ronnebeck.

Arizona Man Is Killed by Illegal Alien Felon Still in America Thanks to Obama’s Amnesty

President Barack Obama has given thousands of criminal illegal aliens amnesty by refusing to deport them after they have been convicted of felonies.

One such recipient took advantage of Obama’s unconstitutional generosity and killed a U.S. citizen in cold blood over a pack of cigarettes in Mesa, Arizona early Thursday morning.

Pinal County Sheriff Paul Babeu took to Twitter on Friday to criticize the Obama administration for failing to deport the illegal alien:

“This illegal was let out on probation for burglary. Why was he not deported? A truly terrible, heartless crime. http://bit.ly/1upgr5U”

Blame the Judge's and the prosecutors they are the ones letting the criminals back out on the street. This could have been any convicted felon. He took a plea deal for second-degree burglary to have theft and kidnapping charges dismissed. He was sentenced to two years of probation?

He should have been deported not put on probation. The obama worm will insist some employer hire him and hand him his $35,000 check.

It's off subject, but the family of the murdered man should have the recourse to sue the judge and prosecutors because of that. If they had to pay that man's family 50 to 100k out of their pockets, that BS might stop.

Hey, if you're gonna lie and pull some stupid, arbitrary number out of your fat but, go for it. Make it at least $75K.

And don't forget that no American citizen has ever committed a crime while out on bond.

Too bad the Rs cut funding to Border Patrol but get used it because that's what they're doing again.

No ... judges and prosecutors have no choice but to follow the law.

He should have been deported but since the Rs don't like that Obama is deporting criminal illegals, they've made it much harder to deport. I posted a link about this a couple of days ago. There's no excuse for this being used as a political football and I hope families sue.

He should have been deported immediately.

whats a little collateral damage compared to a transformed America.......he should be happy for his selection as hero of the republic

Maybe the left can use my phrase of acceptable risk when looking to the ultimate reward of a vote
