Official: Justice Department plans to sue over Arizona law

The point of decision will be the concept of federalism: is the state appropriating power given to the national government. The basis of decision will not be that the state has a need or can do it well, but rather that the state does not have the authority to do so.

The Supremacy Clause does not work that way. The Supremacy Clause would "pre-empt" the state law if the state law was inconsistent with the federal law. But, AZ's law is essentially (and actually in all factual areas of import) the same as the federal law. It only provides that state officials can enforce the federal law. Since there are no factual differences between the federal and state law, the state law will not be pre-empted and a state is within its rights to have such a law.
Enumeration gives congress the power to create legislation regarding naturalization, but there is nothing in the constitution that authorizes congress to create legislation concerning illegal immigration. This was obviously meant for the states to deal with. However, the constitution does oblige the feds to protect the states from invasion.

It's clear that Obama does not care one way or the other. He is here to create havoc in this country and has a few more years to accomplish it.
 
Hmmm, they are going to sue. So who's going to pay for the Justice Department lawsuit? Last time i check, Washington is borrowing money to pay for bailouts. Should we balance the budget / gain surplus and then proceed with extracurricular activities? The Justice Department should use the money that would go to a lawsuit and buy a poll that will ask Arizonians if they support the bill. If the support is greater than 60% of the population, then you should proceed to follow the voice of the people rather than the angry cries of those breaking and entering opponents of immigration.

They obviously aren't going to make a push to secure the border. OL"BO and the Dems are trolling for the Hispanic vote just like Bush and Clinton before em.

I think this suet is just cover so they can show Hispanice, "Hey Man. " We're looking out for you". Look at us. We're takin this to the SC. Of course they are hoping the SC rules in their favor. That remains to be seen. If the SC rules in AZ;s favor, well, a big fat ooppsie.

If Obama did his job, Arizona wouldn't have to enforce federal law.

Problem is that Obama is nowhere close to being qualified to be our President. He gives new meaning to the word incompetent. He'd rather play golf, sing with Paul, or give advice to Lebron James. BO will go down in history as more incompetent that Jimmy, and that's saying something!
