Obama Administration Clarifies Rules on Abortion Funding in Health Care Legislation - Political Punch


While the solicitation said that “elective abortions are not covered,” it also stated the plan would include “only abortions and contraceptives that satisfy the requirements” of a number of Pennsylvania statutes -- including one stating that abortions can be provided by physicians who determine in “his best clinical judgment, the abortion is necessary ... in the light of all factors (physical, emotional, psychological, familial and the woman's age) relevant to the well-being of the woman. No abortion which is sought solely because of the sex of the unborn child shall be deemed a necessary abortion.”

To Johnson, that suggested that “federal funds will subsidize coverage of abortion performed for any reason, except sex selection. The Pennsylvania proposal conspicuously lacks language that would prevent funding of abortions performed as a method of birth control or for any other reason, except sex selection -- and the Obama administration has now approved this."

The Associated Press: Questions over abortion in new federal health plan

Federal officials say elective abortion is barred under the Pre-Existing Condition Insurance Plan. It offers coverage to people turned down by private insurers because of medical problems, at rates comparable to what the healthy pay.

But at least one state — New Mexico — initially listed elective abortion as a covered benefit, reversing course after The Associated Press inquired on Wednesday.


Michelle Lujan Grisham, deputy director of the New Mexico Medical Insurance Pool, said the state's contract with HHS stipulated that the plan must follow federal law, but there was no clear-cut mention of abortion coverage.

As a result, New Mexico included elective abortion as a covered benefit, following what it was already doing with its own state health programs.

An Internet site describing the New Mexico plan listed "elective termination of pregnancy" as a covered benefit. The plan would pay 80 percent of the cost of an abortion, after the beneficiary met a $500 annual deductible.

Asked about coverage of elective abortion by the AP on Wednesday, Grisham initially responded that the state intended to follow through with its original plan.

A little later, she called back to say her agency was reversing course. "We are in the process of correcting the package so it will not have elective abortion coverage," said Grisham.

The Pennyslvania plan, she said, is not yet up and running. The insurance commissioner is in the midst of contract negotiations. . .

Department of Health and Human Services spokeswoman Jenny Backus said ”in Pennsylvania and in all other states abortions will not be covered in the Pre-existing Condition Insurance Plan (PCIP) except in the cases rape or incest, or where the life of the woman would be endangered.”

The outrage is based on a solicitation, not a contract. The contract is being negotiated and the Feds have made their stance clear. Thus one can assume that the final contract will differ from the state's solicitation on this matter.

Put them together, one state is fixing the issue the other is not. If it doesn't fix the issue then the Health care bill will fund elective abortions with federal funds. The title is an attention grabber with the information included inside the original and 3rd posts.
