Is Alabama immigration law creating a 'humanitarian crisis'?
October 6, 2011 - With the Alabama immigration law taking effect, some 2,000 Hispanic students didn't attend school Monday. Teachers unions and Hispanic activists are voicing their concerns.

US teachers unions and Hispanic activists said Wednesday that an Arizona-style immigration law upheld by a federal judge last week is creating a "humanitarian crisis" as thousands of parents keep their children home, fearing that teachers will act as immigration agents. Alabama's first Republican supermajority since Reconstruction approved this summer what many consider America's toughest immigration law. And last week, federal Judge Sharon Lovelace Blackburn surprised many Americans when she upheld key parts of the law – including a portion that says schools must check the immigration status of children when they enroll, as well as the status of their parents.

"This law revisits Alabama's painful racial past," Sam Brooke, a staff attorney for the Southern Poverty Law Center in Montgomery, Ala., said in a conference call with reporters Wednesday. "When a law that demonizes people to the point of pushing children out of schools is cheered, it's a dark day for the state and the country." Lawmakers and Gov. Robert Bentley (R) have said they were forced to pass the state law because the US government had failed to enforce federal immigration statutes. The state law is designed to ensure the safety and economic security of Alabamians, the officials say. ”It’s heartbreaking to read about [children being pulled out of school], but it’s going to be an immigration bill or it’s not going to be one," state Sen. Rusty Glover (R) told the American Independent News Network. Senator Glover voted for the law and is a history teacher in Semmes.

Federal courts have struck down large parts of similar legislative attempts by other states, but Judge Blackburn allowed key provisions in the Alabama law to stand, saying they passed constitutional muster because they reinforced existing federal law. Teachers unions and Hispanic advocacy groups, as well as the Obama administration, have filed an appeal, but the law began to take effect this week. Some 2,000 Hispanic students did not show up to school Monday, according to state education officials. That figure amounts to about 7 percent of the state's Hispanic student population.

Yet education officials have vowed that even children without birth certificates attempting to enroll will be allowed to attend school. Information about a child’s immigration status "will not be used to individually identify your child," but rather will be used only to report "statistical data," interim state superintendent Larry Craven said in a statement Wednesday. The statistics will be gathered by the state Department of Education to track the cost of educating illegal immigrants. The US Supreme Court ruled in 1982 that states cannot deny a free public education to undocumented immigrants. Hispanic advocates said they've been counseling parents to send their children to school.

Terrified by Alabama's strict new immigration crackdown, parents illegally living in the state say they are doing something that was unthinkable just days ago — asking friends, relatives, co-workers and acquaintances to take their children if they are arrested or deported. Many illegal immigrants signed documents in the past week allowing others to care for their children if needed, assistance groups say. A couple living illegally in Shelby County extracted a promise from the man's boss to send their three young children — all U.S. citizens — to Mexico should the parents be jailed. A key sponsor of the immigration law, state Sen. Scott Beason, said such concerns weren't raised when legislators were considering the bill, and he wonders whether the stories are designed to "pull on heart strings" and build sympathy for illegal immigrants.

But for Maria Patino, who said she prays every time she leaves home, even a chance encounter with police could end with her two elementary-age children being left alone or taken to foster care if she and her husband are sent back to Mexico. Both are in the country illegally and have no friends or kin close enough to take in the kids. "Every time I leave, I don't know if I will come back," Patino, 27, said through tears. "I can't stop working. My daughters need shoes and other things." Social worker Jazmin Rivera helps dozens of Spanish-speaking immigrants fill out paperwork weekly. Many are now seeking legal documents called powers of attorney so friends and others could care for their children. "People are scared, and they want to be sure their kids are safe if something happens to them," said Rivera, a case manager at the Hispanic Interest Coalition of Alabama.

Beason, R-Gardendale, has his doubts about how widespread such cases really are. "I would do whatever it took for my family to stay with me," he said. "It's beyond my comprehension that you would just leave your children anywhere." Alabama's law, regarded by many as the toughest in the U.S., was passed by the Republican-controlled Legislature this year and signed by Gov. Robert Bentley. A federal judge blocked some parts of it but allowed key pieces to stand — including a provision that allows police to hold suspected illegal immigrants without bail. On Friday, the U.S. Justice Department and civil rights groups asked a federal appeals court to block the law, saying it could lead to discrimination against even legal residents. However, the law will remain in effect at least until Nov. 29, when the appeals court said it would hear oral arguments.

Illegal immigrants say that leaves them little choice other than to seek out people to care for their children. Cristian Gonzalez, 28, said she has informally asked the manager of the rental property where she lives to take care of her 10-year-old daughter should she and her husband be arrested, so her daughter can finish school here. Gonzalez said their other three kids are too young to remain and would go back to Mexico with her and her husband, even though they are U.S. citizens. "We're afraid to go back to Mexico because of the drugs, the cartels and the killings," Gonzalez said. "And we are afraid to stay here because of the law."

"The statute has the purpose, and has already begun to have the effect, of driving aliens from the State of Alabama, thus imposing burdens on other states."

Well maybe the transnationalist and the international left are refusing to enforce our laws on purpose...Maybe they hate Borders and the fact that this country right up into the 1970's was 90 percent white.
