The dirty little secret that the dirty little anarchist commie bastards leave out is that the NRA wants what everyone wants and that is access to the judicial process. Years ago Black people and American Indians (and women) were automatically adjudged to be too mentally incompetent to sign a document. Today the crazy left might find that evangelical Christians are too mentally incompetent to purchase a firearm. Who knows? All the NRA wants to do is insure that all Americans have the right to petition the government before their Constitutional rights are taken away.

The ACLU and 23 national disability groups did not oppose this rule because we want more guns in our community. This is about more than guns. Adding more innocent Americans to the National Instant Criminal Background database because of a mental disability is a disturbing trend — one that could be applied to voting, parenting or other rights dearer than gun ownership. We opposed it because it would do little to stem gun violence but do much to harm our civil rights.

No one wants a delusional sociopath to have guns. But I have been diagnosed with Attention Deficit Disorder. That is a mental illness. Will I lose my right to own firearms? What if the lunatic rightwingers get homosexuality listed as a mental illness again? Do they lose their constitutional rights?

We already have the NICS background check that refuses a sale of a firearm to anyone who, among other things "Has been adjudicated as a mental defective or committed to a mental institution".

What the NRA is doing is propagating a slippery slope fallacy; that if we enact necessary, proper, and Constitutional firearm regulatory measures – such as a UBC – ‘gun confiscation’ is soon to follow.

Needless to say the notion is idiocy.

The fact is that having a mental condition or disorder will not render someone a prohibited person; only an individual adjudicated by a magistrate to be a threat to himself and others the consequence of his mental condition will be placed in the NICS database.

And those with a mental condition or disorder will always be afforded the right to due process to demonstrate they should no longer be designated a prohibited person.

you do know that 'mentally ill' is not the same as those who were banned under the GCA of 68, codified at 18 USC 922 et seq. The NRA supports the rights of American citizens to own firearms-as long as they have not been legally barred from doing so. Is it your learned argument that anyone with a mental illness is barred from owning guns? Or are you so hateful of gun rights that you want to deny everyone the ability to own firearms? Either way, your pissy hatred of the NRA is based on dishonesty.

How does the federal government-in light of the Supreme Court's reticence to continue the Wickard v Filburn facade past settled precedent, get the power to demand private citizens (barred from engaging in ANY inter-state sales of firearms) conduct background checks for INTRA-STATE sales of second hand firearms?

I would say those who pretend that the second amendment does not cover anyone other than those adjudicated incompetent to exercise the right, are mentally ill and most likely mentally deficient.
