There is no Constitutional Right To Privacy.

What there is are protections of the 3rd, 4th, and 5th Amendments. So long as the literal wording of those amendments are not violated. I would not chance an argument in court on the existence of that right unless I knew the judge had a habit of reading things that were not in the document.

Instead, If I wanted to argue the point, I would make my case based on the 9th Amendment.

The literal wording literally allows me to pull anything out of thin air and make a case for it. So, you get the right to snort coke, the right to skydive in the nude, the right to dance naked for money, the right to be a prostitute and sell drugs, the right to drive pink cars, the right to listen to 90's boy bands or Elvis covers, surf the internet to piss people off, and the list goes on.

Lest we forget, the Ninth Amendment reads: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
