Looks like Phil might own A&E after all this is over. Specifically, A&E violated Title VII of the Civil Rights Act of 1964.


Title VII of the Civil Rights Act of 1964:

Title VII of the Civil Rights Act of 1964 (Title VII), which prohibits employment discrimination based on race, color, religion, sex, or national origin. SEC. 2000e-2. [Section 703]

(a) Employer practices

It shall be an unlawful employment practice for an employer -

That’s what discrimination is. It's law.

Weren't Robertson's anti-homosexual remarks rooted in Biblical verse?

If true, then, The Law may be about to work in favor of Freedom OF Religious Expression for once...

A delicious and long-overdue possibility...

A & E is already on public record as declaring that he was suspended over his homosexual-focused remarks, rather than any of his other pronouncements...

Too late for A & E to backpedal on that one...

Now, all that remains to be seen is whether Robertson can claim discrimination on the basis of Religious Expression...

He covered his ass pretty damned well - intentionally or uninentionally - by quoting a lot of Bible verse in his speech-i-fying...

It may be the angle he needs to use the Freedom of Religion lever...

Which may yield-up an open-and-shut case at-law, with respect to Religious Discrimination...

And, even though it's only a 'suspension' on paper, he can probably play it for a Wrongful Termination regardless; creating conditions that made it impossible to stay; not to mention some kind of slander gimmick...

A lot probably depends upon the verbiage in his contract and his status as a contractor or employee...

Looking forward to seeing how this one plays out...

That's what makes horse races and lawsuits.

Overcoming the morality clause is the easiest part. A&E had full knowledge of Robertson's beliefs and knew the questions GQ was going to ask. A representative of the network was present during the questioning and never raised an objection. The morality clause was waived and Robertson's statement approved by failure to timely object.

First, a review would need to be conducted to determine if indeed the relationship between the network and the cast member actually constitutes an employer/employee relationship subject to Title VII protection.

But assuming such a relationship existed, the cast member wasn’t suspended because he was a Christian, the cast member was suspended because he made false, hateful, and ignorant statements concerning gays and African-Americans that didn’t comport with the networks policies, having nothing to do with Christian doctrine or dogma.

The cast member wasn’t suspended because the network doesn’t want to be associated with Christians, the cast member was suspended because the network doesn’t want to be associated with hateful bigots and racists, which is perfectly legitimate grounds for a suspension.

He was asked about his religious beliefs on homosexuality. He paraphrased scripture that went right over the top of the executives heads who with a knee jerk reaction let him go because GLAAD threatened them.

Do you idiots really think that a company as big as A&E doesn't have a bunch of lawyers who went through his contract before they made their announcement to make sure that the suspension was legal?

I mean, fucking seriously, this isn't some little mom-and-pop outfit who has a half-assed lawyer on retainer. A&E probably has in-house counsel who read through his contract and made sure that it was kosher before they pulled the trigger on the suspension. Assuming as much really isn't rocket science.
