The Republicans have to, in effect, say "we aren't going to let the president exercise his Constitutional powers, we reserve those powers to Congress".

This of course is a breech of the separation of powers between the branches of government. The president should just start nominating whoever he wants immediately and make them hold hearings and reject them one after the other. Once again, Obama will breach protocol, thinking only of himself and his legacy. The man has an ego the size of Alaska. I suspect the moment Obama heard of the passing of Justice Scalia, he started scrambling about looking for his staff to throw together a list of the the most fasr left wing judges and lawyers they could come up with for nomination...
The one saving grace.....The Senate will not confirm any nominee they see as not a defender of the US Constitution nor will they allow Obama to pack the court with a left wing Jurist.
