A growing group of chain-store corporations that cater to America's poor with cheap goods are classifying workers as managers. By categorizing employees as salaried managers these dollar stores avoid paying overtime wages that the Fair Labor Standards Act mandates for hourly workers.

Major corporations have been making "management" positions for decades for non managerial positions to avoid labor laws.

what is a growing trend is making "employees" independent contractors by making the sign a 1099 form to get the job.
The are entitled to no workmans comp, OT or unemployment.

The FLSA goes by work actually performed. A company can call someone a manager or any other exempt position, but that won't fly under an actual investigation.

Well, sure...you can't enforce a law in most cases unless there's a complaint. There was a similar problem with a lot of dotcoms and small companies putting computer support people and programmers as salaried when they should be hourly. It took a while for DOL to put the smack down on that, and it has continued in some areas ... I know some help desk people who were re classified as hourly only 3-4 years ago.

Companies do a lot of scams, like trying to average hours over the pay period to avoid overtime, which is illegal. If a pay period is 2 weeks and an employee works 45 hours in week 1 and 35 hours in week 2, she is still entitled to 5 hours overtime pay for week 1. But not enough employees know this and get ripped off.

I worked in a support, programmer position for 10 years with a major telecom. A managerial position?
We also imported lots of H1B workers and offshored most of the work to India. A violation of federal law giving foreign programmers and such access to US telephone customer records.

yeah right investigations....
 
The Federal minimum wage should be repealed. The Federal Government has no business involving itself in a state issue.
