Perhaps this sheriff ought to go back to cop school, for a remedial due process class. If he needs to see medical records, all he has to do is swear out a warrant, stating probable cause, and have a judge sign it.
That would be true in the case of the individual subject of an individual investigation in which there is probable cause. This drug warrior is seeking the power to randomly access the medical records of everyone who uses prescribed pain killers.

The difference is a national medical records database will be accessible to medical professionals, not law enforcement.

That would be false, since it would be a felony to access a medical database for fishing purposes. Law enforcement would need a warrant to gain access on an individual.

Tell me the last time law enforcement, outside of HHS, was permitted to access the Medicare database?
 
Looks like a clear violation of the 4th amendment to me. They should need a warrant for this.
