Almestadi will now be remanded to a psychiatric hospital and be subject to the B.C. Review Board, which conducts periodic reviews of such cases.

It's not as though the judge released him.

Andrea Yates was eventually found not guilty by reason of insanity. This appears to be a very similar kind of ruling, although obviously Canada and the US have some differences in judicial systems.
