A U.S. appeals court is awarding death-row activist Mumia Abu-Jamal a new sentencing hearing in the 1981 murder of a Philadelphia police officer.

Tuesday’s ruling is the latest in the former Black Panther’s long-running legal saga.

The 58-year-old Mumia’s first-degree murder conviction stands in the fatal shooting of Officer Daniel Faulkner.

But the 3rd U.S. Circuit Court of Appeals is upholding its earlier ruling that the death-penalty instructions to the jury were unclear at Mumia’s 1982 trial.

There is no question about his guilt, yet he is practically a household name. I'd imagine half his supporters believe he has been railroaded by "da man". Disgusting piece of shit. Shame on his "fans".
 
It should be law that NO ONE sits on death row for more than 10 years. Either your executed or your released. Appeals shouldn't be allowed to drag on for eternity.
 
In my mind "Proper Judical Procedure" would have been for him not to have been brought in alive to begin with after having shot a police officer.

He killed the cop, there is no doubt. It was cold blooded and despicable. He shot him from behind.

Exactly when does Justice get a say?

When it comes to justice in the United States there are two types: substantive(the punishment fits the crime) and procedural justice(the process). If we are going to determine that someone deserves death for a crime they committed I sure as hell want to make sure that all the "i" are perfectly dotted and "t" perfectly crossed in all phases and processes of their trial before we kill them.
 
This thread is about politics, not the law – the former often contaminates the latter.

Otherwise this is a non-issue: the Court has already reviewed the case and sent it back to the U.S. Third Circuit Court of Appeals which ruled this week that Abu-Jamal is entitled to a new sentencing hearing. The verdict stands.

Those who understand and appreciate the genius of the Anglo-American judicial tradition should support this process, regardless how long it takes.

Ever time Officer Faulkners bloody shirt was shown, this filth turned a grinned at his widow.

He's happy he killed a cop AND he revels in the misery it's causing his family.
