They were not speaking as Jewish theologians, but as advocates for civil liberty. The laws of man are not the laws of God, and are to be judged by a different standard.

The law of God trumps the law of man, and God says gay is a sin. God is always right.

According to Matthew 22:21, Jesus said, "Render unto Caesar the things which are Caesar's, and unto God the things that are God's"

Therefore, mans law rules here on Earth, Gods law rules what's beyond.
