they are allowed to wear it around their neck because of freedom of speech. Just like a student is allowed to wear a Cross around his/her neck.

Did you watch the video? It is not worn around the neck it is on the BELT, it is not a trinket necklace but a 3-4 dagger by his side. How you can compare a one inch cruifix necklace to the dagger worn on the belt is far beyond me.
