Men's Magazine Prompts Florida Sex Offender's Arrest

MIAMI, Florida (AP) -- Authorities in Florida are sending convicted sex offenders to jail for violating the terms of their probation by having men's magazines such as Maxim.

Andrew Calderon, 23, was jailed for six days before a judge ordered his release after officers found a racy poster and calendar and copies of Maxim in his home earlier this year.

A judge will decide next month whether Calderon's probation should be revoked or extended and whether the materials were innocent.

Corrections officials said Calderon, who was on probation for the sexual battery of a mentally disabled relative, committed a violation by having "sexually stimulating" material.

But in court papers, Calderon's lawyer, Mel Black, described Maxim as far from obscene.

"This is beyond schoolmarmism here. It's really mind-blowing," Black said.

In another case, sex offender Joseph Conte, 56, was arrested when authorities found a copy of a sex manual in a drawer next to the bed the former schoolteacher shares with his wife. A judge later dismissed the probation complaint.

Florida authorities have increased their surveillance of sexual offenders since two young girls were slain earlier this year, both of them allegedly attacked by sex offenders who were free on probation.

So...using this reasoning, he can't watch R rated movies, any Porn, Desperate Housewives, read any of the "smutty women's books" or have phonesex with his girlfriend?

He should just claim to be Gay, and he buys maxim for the Articles. :)

This one really freaked me out. So the "probation - police" are entering people's homes, searching their drawers (pardon the pun) to see what they can find?

My first thought as well, but that could have been a condition of probation. I donno, I'm still uncomfortable with it. On the otherhand I don't know all the facts..

he is on probation...he committed a crime...he has waived his rights....or he can go back to jail

I know. What I don't know is the conditions of his probation. That is important. I can't really comment unless I do.

If he was convicted of Rape or another sexual assault crime like that they often will make that part of the Parole or Probation.

I remember a story where a NAMBLA member was jailed after his Parole for writing about his fantasies in a diary.
 
is that when one is on "Probation" or parole it is the same as being in jail...only instead of correctional officers having the authority to search anytime/anywhere...this becomes the probation officers job with full authority.

If the conditions of his probation stated he was not to have obscene or sexually stimulating material...oh well to jail he goes!

thats what they should be doing. those sick fucks dont deserve the privacy decent people enjoy. they should search their homes at least once a week for the littlest proof of indecency.
now i know this is a pipe dream as it seems we cant keep track of some of the sickos. they should also be castrated. not that sissy chemical shit, but a dull butter knife. they dont deserve to have those feelings anymore.

There is some evidence to suggest that provacative magazines do have a sexually stimulating effect on men who are sex offenders so it could very well be conceivable that this was included in the terms of their probation.

But like you Im uncomfortable with the way this was conducted. It seems they either go too lax or too much the other way in extremes when dealing with sex offenders.
 
The terms of the guy's probation are important here. In some probation cases, the terms include random surprise home visits.
