More proof that the only reason he ever had ANY success in business is because he had the cash to make it work. He certainly doesn't have any real business ability.


That's certainly true.

He was never anything more than the spoiled son of a well off and crooked real estate developer from Queens. He has lived off his father's money for most of his life. His most famous deals have largely been disasters.

And the things he has been involved in since his father died generally consisted of scams like Trump U and fake Trump Steaks, to profiting off the money laundering that goes through Trump properties and properties that Trump manages for others (which is vast majority of the buildings that bear the Trump name). He is not a builder of equity.

And since his father died, he has been forced to sell of most of his father's assets in order to clear his debts and defaults. He was forced to sell the Hudson Yards parcel in 2008, for far more than his current declared net worth. Where did the money go? If this guy is the financial genius that he promotes himself as being, he should be worth a lot more than even he claims he is (and which NO ONE believes).


Now, he's on the hook to a bunch of Russian gangsters, ones who hold all the Trump chips.

Wow. Way to demonstrate why white nationalism is the primary pitch of the Republican party when pushing their message to conservatives.

Whittaker's appointment obviously isn't constitutional. As such an appointment is only authorized under the Federal Vacancies Reform Act if the person has served as the first assistant to the Attorney General.

(1)Notwithstanding subsection (a)(1), a person may not serve as an acting officer for an office under this section, if—
(i) did not serve in the position of first assistant to the office of such officer; or

(ii) served in the position of first assistant to the office of such officer for less than 90 days; and

5 U.S. Code § 3345 - Acting officer

With the FVRA making it crystal clear who the first assistant of the Attorney General is:

In case of a vacancy in the office of Attorney General, or of his absence or disability, the Deputy Attorney General may exercise all the duties of that office, and for the purpose of section 3345 of title 5 the Deputy Attorney General is the first assistant to the Attorney General.

28 U.S. Code § 508 - Vacancies

The Deputy Attorney General.

Whittaker has never served as the first assistant to the Attorney General. Making him ineligible for the position of acting Attorney General under FVRA. And there is zero provision for unconfirmed principal officers in the Constitution.

Leaving only Rosenstein. Or no one until the president nominates and the Senate confirms a new AG.


According to this the President has authority to name an Acting Attorney General under the Vacancies Reform Act, 5 U.S.C. §§ 33453349d (2000 & Supp. IV 2004), even if an officer of the Department of Justice otherwise could act under 28 U.S.C. § 508 (2000). As we advised orally, we believe that the President has this authority.
