WASHINGTON - The military’s top appellate court dismissed the judge in the Fort Hood shooting case, saying he appeared to be biased.

The U.S. Court of Appeals for the Armed Forces here ruled Monday that Col. Gregory Gross had acted in a way that would make a reasonable person “harbor doubts about [his] impartiality.”

As they haven't yet appointed a judge, how much longer is this circus going to take? I agree it is the command's responsibility to make this turd shave off his beard. But how? Shackle him and have someone take a razor to it? Does that leave his lawyers the option of filing a "cruel and unusual treatment" case for him? Would that further delay the trial?

On the other hand, maybe removing this judge is but a chance to ensure any judgment not be overturned on appeal. Don't give the ambulance chasers any options once he's found guilty and given the punishment of hanging.

FORT HOOD, Texas — The Army’s highest legal branch appointed a new judge to preside over the case of the Fort Hood shooting suspect, indicating the court-martial is on track to move forward after lengthy delays.

Army Col. Tara Osborn was named Tuesday to head the case of Maj. Nidal Hasan, who faces the death penalty if convicted in the 2009 shootings that killed 13 and wounded more than two dozen on the Texas Army post.
