Today, on Sean Hannity, when Jeff Jacoby asks Tamara Holder to defend a, say, President Huckabee declaring civil rights legislation "unconstitutional", she declares, "that's different, civil right legislation makes sense"

I might be missing something but its not within the scope of the presidents power to declare a law unconstitutional. If this is regarding DOMA, he merely wants DOMA to withstand a higher level of constitutional scrutiny... an issue that the Supreme Court must decide.
